Terms of service

These Terms of Service govern your use of michiaelio.com and your purchase of any product from Michiaelio ("we", "us", "our"). By using the site or placing an order you agree to be bound by these terms. If you do not agree with them, please do not use the site.

We may update these terms from time to time by posting a revised version on this page. Continuing to use the site after a change means you accept the revised terms.

Our store is hosted by Shopify Inc., who provide the ecommerce platform that lets us sell to you.

1. Who can use this store

You must be the age of majority in your state or country to buy from us, or have the consent of a parent or guardian. You may not use our products for any unlawful purpose, and you may not attempt to interfere with the security or operation of the site.

2. Products, descriptions and pricing

We do our best to describe and photograph our products accurately, but colours can vary between screens and we cannot guarantee that what you see on your display matches the item exactly.

Prices may change without notice. We may limit or refuse an order, limit quantities per person or per household, or discontinue a product at any time.

Occasionally a listing may contain an error in its description, price, promotion, shipping charge or availability. Where that happens we may correct the error and change or cancel the affected order, including after it has been placed. If we cancel an order for this reason we will refund you in full.

3. Stock and availability

Some of our products are shipped from stock held ready, and others are made or collected to order. This affects how quickly an order leaves us. Our Shipping Policy sets out the timeframes you can expect. If an item you ordered turns out to be unavailable, we will contact you and offer a replacement or a full refund.

4. Orders and payment

You agree to give current, complete and accurate billing and account information for every purchase, and to keep it up to date so we can complete your order and contact you if we need to.

Orders with incorrect billing details, or that need extra verification, may be delayed or cancelled. Card details are encrypted in transit.

5. Shipping and returns

Delivery timeframes, tracking, customs charges and lost parcels are covered in our Shipping Policy. Returns and refunds are covered in our Refund Policy. Both form part of these terms.

6. Your account

If you create an account you are responsible for keeping your password secure and for activity that happens under your account. Tell us promptly if you think someone else has access to it.

7. Third party links and tools

Our site may link to websites we do not operate, and may make third party tools available to you. We do not control those sites or tools and are not responsible for their content, accuracy or practices. Review their own terms and privacy policies before using them.

8. Your submissions

If you send us reviews, comments, ideas or other material, you agree we may use, edit and publish it without payment or obligation to keep it confidential. You are responsible for what you submit. Do not submit anything unlawful, abusive, defamatory, obscene, or that infringes someone else's rights, and do not impersonate anyone. We may remove content at our discretion.

10. Disclaimer and limitation of liability

We do not guarantee that the site will be uninterrupted, secure or error free. Except where we have said otherwise, products and services are provided as is and as available, without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

To the fullest extent permitted by law, Michiaelio and its owners, employees and suppliers will not be liable for any indirect, incidental, special or consequential loss arising from your use of the site or any product bought through it, including lost profits, lost data or replacement costs. Some states do not allow these exclusions, and where that is the case our liability is limited to the maximum extent the law allows. Nothing in these terms limits liability that cannot be limited by law.

11. Indemnity

You agree to indemnify and hold harmless Michiaelio and its owners, employees, suppliers and service providers from any claim arising out of your breach of these terms or your violation of any law or of the rights of a third party.

12. Severability

If any part of these terms is found to be unlawful or unenforceable, that part is severed and the rest continues to apply.

13. Termination

These terms apply until terminated by either of us. You may stop using the site at any time. If we believe you have breached these terms we may end your access without notice, and you remain liable for any amounts owed up to that point.

14. Entire agreement

These terms, together with the policies referenced in them, form the entire agreement between you and us about your use of the site, and replace any earlier agreements or understandings.

15. Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules.
